Terms and Conditions

1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Client", "you", "your") and True Line Electrical ABN 29 696 139 929 ("we", "us", "our", "True Line Electrical") governing your use of our electrical services.

By booking, requesting, or accepting our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.

2. Services

True Line Electrical provides the following electrical services:

  • Rental electrical safety checks and smoke alarm compliance
  • Switchboard upgrades and replacements
  • EV electrical readiness assessments and upgrades
  • Insurance restoration electrical works
  • Strata and facility management electrical services
  • Related electrical compliance and upgrade services

All electrical work is performed by licensed Victorian electrical contractors in accordance with the Electrical Safety Act 1998 (Vic), AS/NZS 3000:2018 Wiring Rules, and all applicable Australian Standards.

3. Bookings and Appointments

3.1 Booking Confirmation

A booking is confirmed when you receive written confirmation (email or SMS) from us. Verbal agreements are not binding until confirmed in writing.

3.2 Access Requirements

You must ensure safe and clear access to the property and all areas requiring electrical work, including switchboards, roof spaces, and sub-floor areas where applicable. Failure to provide adequate access may result in rescheduling and additional charges.

3.3 Cancellation Policy

  • More than 48 hours notice: No cancellation fee
  • 24-48 hours notice: 50% of quoted service fee may apply
  • Less than 24 hours notice: Full service fee may apply
  • No-show: Full service fee applies

We understand emergencies occur. Please contact us as soon as possible if you need to reschedule.

3.4 Rescheduling

We reserve the right to reschedule appointments due to unforeseen circumstances, weather conditions, or emergencies. We will provide as much notice as possible and work with you to find a suitable alternative time.

4. Quotes and Pricing

4.1 Fixed Pricing

Where we offer fixed pricing (e.g., rental compliance checks), the quoted price is final and includes all standard work as described. Fixed prices are valid for 30 days from the date of quote.

4.2 Quoted Work

For work requiring assessment (e.g., switchboard upgrades, insurance restoration), we provide a written quote after inspection. Quotes are valid for 30 days unless otherwise stated. Work will not commence until you accept the quote in writing.

4.3 Variations

If additional work is required beyond the original scope (e.g., unforeseen issues discovered during work), we will:

  • Stop work and notify you immediately
  • Provide a written quote for the additional work
  • Only proceed with your written approval
  • Document all variations for your records

4.4 GST

All prices quoted include GST unless otherwise stated. ABN: 29 696 139 929.

5. Payment Terms

5.1 Payment Due

Payment is due on completion of work unless alternative arrangements have been agreed in writing. For larger projects, we may require a deposit or progress payments as specified in the quote.

5.2 Payment Methods

We accept payment by bank transfer, credit card, and debit card. Cash payments may be accepted by prior arrangement.

5.3 Overdue Payments

Invoices not paid within 14 days of the due date may incur:

  • Interest at 2% per month on the outstanding balance
  • Debt recovery costs if collection action is required
  • Suspension of future services until the account is settled

5.4 Insurance Work

For insurance restoration work, we can bill insurers directly where approved. You remain responsible for payment if the insurer does not pay within 30 days of invoice.

6. Warranties and Guarantees

6.1 Workmanship Warranty

We warrant that all work will be performed in a professional and workmanlike manner in accordance with applicable Australian Standards. Workmanship is warranted for 12 months from the date of completion.

6.2 Materials Warranty

Materials and equipment supplied by us carry the manufacturer's warranty. We will assist with warranty claims where applicable.

6.3 Warranty Exclusions

Warranties do not cover:

  • Damage caused by misuse, neglect, or unauthorised modifications
  • Normal wear and tear
  • Damage caused by power surges, lightning, or other external events
  • Work performed by others on the same system
  • Pre-existing defects not identified in our original scope

6.4 Consumer Guarantees

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract and receive a refund for the unused portion, or compensation for its reduced value.

7. Compliance and Certification

All electrical work requiring certification will be accompanied by a Certificate of Electrical Safety as required by Victorian law. Certificates are issued on completion of work and provided to you electronically (PDF) and/or in hard copy.

We maintain records of all certificates issued as required by Energy Safe Victoria. You should retain copies of all certificates for your records, insurance, and property sale purposes.

8. Liability

8.1 Insurance

We hold comprehensive public liability insurance and professional indemnity insurance. Certificates of currency are available on request.

8.2 Limitation of Liability

To the maximum extent permitted by law, our liability for any claim arising from our services is limited to:

  • Re-performing the defective work; or
  • Refunding the price paid for the defective work

We are not liable for indirect, consequential, or incidental damages, including loss of profits, business interruption, or loss of data, except where such exclusion is prohibited by law.

8.3 Your Responsibilities

You are responsible for:

  • Providing accurate information about your property and electrical system
  • Disclosing any known hazards (e.g., asbestos, structural issues)
  • Ensuring safe access to work areas
  • Obtaining any required approvals (e.g., body corporate consent)
  • Protecting sensitive equipment during power outages

9. Subcontracting

We may occasionally engage trusted, vetted electrical subcontractors to assist with service delivery. All subcontractors are fully licensed, insured, and bound by confidentiality obligations. We maintain full accountability for the quality of work delivered by subcontractors.

10. Intellectual Property

All reports, assessments, and documentation we provide remain our intellectual property. You are granted a non-exclusive licence to use these materials for their intended purpose (e.g., compliance records, insurance claims). You may not reproduce, distribute, or commercially exploit our materials without written permission.

11. Dispute Resolution

If a dispute arises, we encourage you to contact us first to attempt resolution. We are committed to resolving disputes fairly and promptly.

If we cannot resolve the dispute directly, either party may refer the matter to:

  • Consumer Affairs Victoria for consumer disputes
  • Energy Safe Victoria for electrical safety concerns
  • Mediation through an agreed mediator

These Terms are governed by the laws of Victoria, Australia. Any legal proceedings must be brought in the courts of Victoria.

12. Force Majeure

We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, power outages, or supply chain disruptions.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
